Stark County Planning and Zoning Commission voted March 27 to approve RZ 125, rezoning roughly 12.64 acres from agricultural to agricultural-residential, and to approve the matching minor subdivision plat (MSP 0225) creating the J and C Herning Homestead subdivision.
The actions affect property described as the south one-half of the northeast one-quarter of Section 24, Township 140 North, Range 95 West. County planner Steve Josephson told the commission staff recommended approval, noting the parcel had a prior homestead, existing foundations and agricultural structures and that the proposed lot meets the 10-acre minimum for the AR zoning district.
Josephson said the county’s comprehensive plan designates the area as “prime agricultural” and that the recommended lot size for that designation is 40 acres, but staff found this request acceptable because the parcel had previously been developed with a homestead. He warned that future subdivisions in the immediate area that seek rezoning will require a future land use map amendment and verification that at least 50% of soils are not classified as prime farmland or farmland of statewide importance by USDA data.
Commissioners moved and seconded the rezoning and the plat after hearing no public opposition at the public hearings. A roll-call vote recorded aye votes from Commissioner Vrilich, Commissioner Oderman, Commissioner Riddle, Commissioner Claris, Commissioner White and the chair; the motions carried.
The approval allows the applicants to replace or build a residential homestead on the parcel under the AR zoning district and to record the minor subdivision plat that meets the county’s minor-plat standards. Staff pointed out that any further subdivision or rezoning of nearby parcels in the “prime agricultural” future land use category would require separate review and a future land use map amendment.
