Council postpones Cooperstown development-agreement amendment after staff seeks finalized document

The North Ogden City Council on Feb. 25 postponed action on an amendment to the Cooperstown subdivision development agreement so staff could provide the finalized amendment document and agreement number for council review.

Scott Hess, planning staff, described the proposed amendment as a modification tied to the master planned community (MPC) approval that would remove apartment buildings shown south of the 1500 North right-of-way (in Ogden City) from the Cooperstown development agreement and otherwise leave project requirements intact. Hess said staff and the Planning Commission discussed the amendment and concluded it was a reasonable compromise to move the project forward after jurisdictional boundary issues with Ogden City prevented the project from being considered as a single-jurisdiction development.

Hess said the amendment "essentially keeps everything whole for what North Ogden was originally going to do with the project, but it ignores everything south of the right of way line of 1500 North, which is in Ogden City." He noted outstanding clarifications remain, including whether North Ogden or Ogden would ultimately maintain the southern sidewalk and other utility and billing questions.

Councilors and staff confirmed they did not have the signed redlined amendment or an agreement number at the dais. The council then accepted a motion to postpone consideration to a future meeting. Council member Dalpaz moved to postpone the Cooperstown development-agreement amendment; the motion was seconded and carried by voice vote with all present saying aye.

At the meeting staff noted the site plan in the packet shows a monument sign location on the north end of the project and that the city will prepare the signable amendment and bring it back to council within roughly two weeks for formal approval.
