The recommendation will be transmitted to the Board of County Commissioners; because a valid protest petition was filed the board will need a three‑quarter majority to approve the zoning change. Planning staff’s written recommendation had been denial, and staff reiterated in the meeting that its formal recommendation remained denial pending the planning commission’s action.
Why it matters: The commission was remanding its earlier denial after the Board of County Commissioners asked for fuller discussion. The case centers on whether the existing gravel access, culverts and potential drainage changes can safely and reasonably support intermittent rodeo‑style events and related truck/trailer traffic without creating undue impacts for neighbors or creating a public‑safety hazard for emergency responders.
At issue were technical details about road width and culvert condition. Planning staff said the road was generally closer to 22 feet for the first portion and narrowed in culvert areas; Road and Bridge staff and a county engineer had previously recorded narrower measurements. Applicant Ophelia Banuelos provided an engineering report from a local consultant reporting one culvert is long enough to meet the 22‑foot width with grading and the other would likely need an extension or replacement. Banuelos told the commission her team could accept a reduced event schedule: “we can go to 4 to 5,” she said, referring to the number of events per year.
