Planning commission recommends approval of Fontana‑area rodeo venue with limits; county commission will decide under protest rules

Kenny Cook, Miami County planning director, told commissioners the planning commission reconsidered a prior denial of a conditional‑use permit for a rodeo venue near Fontana. After additional site review, measurements and applicant commitments on road and noise mitigation, the planning commission voted 6–3 to recommend approval, subject to conditions.
Key conditions the planning commission added or clarified include:
- A maximum of five events per year, limited to one day each; - A 10‑year conditional‑use permit term with staff enforcement for conditions; - A maximum noise limit of 65 decibels at the property line; - Dust control and required road improvements where culverts and narrow sections create pinch points; the applicant will be responsible for engineering plans and cost estimates and must work with Road & Bridge for inspections.
Cook said staff and Road & Bridge re‑measured the eastern portion of the access road and found much of it averaged about 22 feet in width, with narrow culvert locations of roughly 18 feet. The planning commission’s recommendation conditions require applicant improvements in these constrained locations; the applicant provided contractor cost estimates (one under $10,000 and another near $15,000 for culvert work) in discussion with Road & Bridge.
Cook also told the board that a valid protest petition was filed during the process, which means the Board of County Commissioners will require a three‑quarter majority (4 of 5 commissioners) to approve a zoning decision on this CUP. Cook said staff plans to return to the board on the scheduled date (April 30) with the planning commission’s recommendation, the road‑improvement details and conditions for any approval.

The board heard the planning department’s summary and scheduling; no final county board vote was taken in the study session. Staff said the item will be placed on the board’s action agenda and that because of the protest petition, approval at the county level will require at least four votes in favor.
