Planning staff explained the county lacked an explicit revocation clause and proposed language to allow the BZA to revoke a special exception if an operator fails to comply with conditions established in the ordinance or imposed by the BZA. Staff said the proposed process includes an initiation path by the Planning and Zoning Department, a public hearing advertised and posted in accordance with Article 21, and at least 30 days’ written notice to the special‑exception holder via certified mail or hand delivery coordinated with codes enforcement.
Staff emphasized the clause was developed with input from the Codes Enforcement Division to ensure the timeline was administrable. A motion to approve the amendment was made by Vincent Simons and seconded by Miss Kearns; the motion carried. The amendment will proceed to county council for final action.
