YARMOUTH, Mass. — The Yarmouth Conservation Commission on Thursday approved a request for determination of applicability to allow the tear‑down and rebuild of a single‑family home at 88 Pinecone Drive and granted a stormwater permit for a mixed‑use redevelopment at 228 Route 28, and it continued two coastal pier/float permit applications to Feb. 20, 2025.
The negative determination for 88 Pinecone Drive, presented by Mike Pimentel of JC Engineering on behalf of the owner (listed in the filing as Slough Palmieri), clears the project to proceed within land subject to coastal storm flowage in Zone AE (elevation 11). "This project involves the tear down and rebuild of an existing single‑family home on a 9,277‑square‑foot lot," Pimentel said, adding the new house will be raised, set parallel to the property, include a crawl space rather than a basement and tie into a new Title 5 septic system. The commission approved the determination by voice vote; the meeting record shows the motion carried unanimously.
The application description and clarifications provided at the meeting say the proposal includes a pervious driveway, replacement water and gas lines, minor grading to maintain existing drainage patterns (stormwater conveyed from west to east) and a shallow swale for stormwater conveyance of about 8–9 inches in depth. Pimentel told the commission the project team has submitted plans to the Board of Health and received preliminary approval from the board's agent. He also said two front yard trees are expected to be preserved but a 20‑inch tree near the proposed septic may have to be removed if the contractor cannot work around it.
Separately, the commission approved a stormwater permit application for SW2024‑002, filed by Emad Saharan for redevelopment at 228 Route 28. The commission chair stated the application had completed peer review and outstanding compliance items and was administratively complete; the commission approved the permit by voice vote with no recorded opposition.
Two coastal permits were continued at the applicants’ request. A notice of intent for Robert and Maureen Kelly at 146 Bay Mayflower Terrace — a proposed reconstruction and expansion of a pier, ramp and float system and replacement bulkhead within multiple coastal resource areas — was continued to Feb. 20, 2025, at the applicant consultant’s request. A second continued notice of intent for a dock (listed under SE80‑3252/452 for Wayne Tavares/Alexander, Alexander Buttercup Lane) was also continued to Feb. 20; staff noted this was the third and final continuance allowed under the commission’s regulations.
On administrative business the commission tabled approval of the Dec. 6, 2024 minutes until the Feb. 20 meeting and approved the Dec. 19, 2024 and Jan. 2, 2025 minutes; the record shows that approval carried with one abstention.
The commission closed the item and noted staff will issue the written determination and sign permit paperwork for the Pinecone Drive project.
