The Yarmouth Board of Appeals on Feb. 13 completed required one‑year reviews for two family daycares and found both operators in compliance with the conditions of the special permits granted in Feb. 2024.
Petition 5070 (48 Butler Ave) was represented by Gabrielli (translated by Beatrice Zemel). The petitioner reported that the operation has been running as approved, that the State’s Department overseeing family day care licensing (EEC) performs yearly inspections, and that the facility typically serves up to six children with hours reported as 7 a.m. to 5 p.m. Monday through Friday. Board members said they had no outstanding complaints on file from police or neighbors and moved to find the petitioner in compliance; the motion passed unanimously.
Petition 5071 (144 West Yarmouth Road) was represented by Jessica Shekel Rose (translated by Beatrice Zemel). Board members confirmed continued EEC oversight, that the daycare operates up to six children during weekday hours, and that a recent change in property ownership had been disclosed and that the new owner lives next door and indicated no objection. The board also moved and voted unanimously to find that petitioner in compliance with the prior special‑permit conditions; both petitioners were told they need not return for further review unless conditions change.
Board members noted the board had no police reports indicating ongoing problems at either location and that state annual licensing remains the primary oversight mechanism for the child‑care program.
