A complaint read to the Yarmouth Commission on Disability on Feb. 13 said the Kmart Plaza parking and curb configuration near the Cape Cod Mall prevents people using wheelchairs from reaching storefronts, and the commission agreed to refer the concern to the town constable for follow-up.
The complainant, who identified themselves as a local resident bringing parents to the plaza, said accessible parking spaces comply with number counts but are “too far away from the front entrance,” and that a “6 to 8 inch curb that a wheelchair cannot get over” blocks access. The witness described an arrangement in which one curb cut serves a middle section of the plaza; reaching some stores requires using a ramp that forces users to descend and then climb other sidewalks, which the complainant said is difficult for people with mobility limitations.
Commission members noted the complainant indicated the parties live in South Yarmouth. Mary, who brought the item to the commission, said construction crews on-site are aware of noncompliant conditions but did not provide formal remedies during the meeting; the commission agreed to pass the complaint to the constable for official follow-up and enforcement as appropriate.
