Yarmouth Select Board approves all-alcohol license and manager for Uncommoner Cape Cod hotel

The Yarmouth Select Board on March 18 approved a Section 12 annual all‑alcohol liquor license for Hari Hospitality Inc., doing business as Uncommoner Cape Cod, and confirmed Parth Patel as the hotel’s manager of record.

At a public hearing, attorney Jackson Christian, representing the applicant, described the property and the application. “My name is Jackson Christian. I’m an attorney at Demakis Law Offices in Lynn. And I’m here representing the applicant, Hari Hospitality Inc., which is doing business as the Uncommoner Cape Cod at 135 Route 28 in Yarmouth,” he said, outlining that the hotel has 102 units, a restaurant with an indoor bar and an outdoor bar, four buildings (two floors each) and about 53,000 square feet of total space.

The board’s hearing clarified that the requested license would cover the entire hotel property. Christian also confirmed the requested hours: 9 a.m. to 11 p.m. weekdays and Saturdays and 10 a.m. to 11 p.m. on Sundays. He said alcohol would be stored in a locked storage room on site and that Parth Patel — who runs nearby properties and holds TIPS certification — was proposed as manager of record. Christian told the board that Patel is already manager of record at another nearby hotel (the Freebird Lodge) and that Patel’s manager status at a third location would be changed so he would not be manager at three premises simultaneously.

Select Board members asked standard questions about premises limits, hours, manager qualifications and whether the hotel intended outdoor consumption. Board members were told the license covers the full property and that the patios are included but that service will be at the restaurant and bar areas; the board discussed the difference between limiting service to a defined restaurant/bar area and permitting consumption across the licensed premises.

After brief public input (no written comments were reported to staff), the board voted to close the public portion of the hearing and approved two motions: one to grant the liquor license as requested and a second to approve Parth Patel as manager of record. The board voice vote was recorded as in favor; no individual roll‑call tally was provided in the hearing transcript.

What the approvals mean: the license allows the Uncommoner Cape Cod to sell and serve all types of alcoholic beverages on the hotel property at the hours described above. The manager of record — Parth Patel — is the person legally responsible for compliance with state and local liquor laws at that location.

The applicant packet on the record includes municipal application materials, TIPS certification for the manager, and green cards/proof of abutters’ notice. The Select Board noted the seriousness of holding a liquor license and reminded the applicant that violations could bring the license back before the board. With the two approvals, the board closed that agenda item and moved to other business.
