The Board of County Commissioners unanimously adopted Resolution 2025‑12 on Thursday reaffirming Okeechobee County’s ownership and control of two road right‑of‑way parcels recorded by special warranty deed in 1972.
County Attorney read the resolution title and summary, noting the deed was recorded in Official Records Book 135, page 621 on or about March 28, 1972, and that the county engineer prepared a sketch showing the two right‑of‑way segments. The resolution “reaffirms and reasserts that the county is the owner of a parcel of real property… and the county has continued control over this right of way,” the attorney said.
Commissioner Sumner and other board members explained the action grew from a property owner’s recent challenge to public access. After discussion the board amended the motion to both record the resolution in the official records and to appear in the related court case as a non‑party with an interest, filing the resolution as a request for judicial notice. The board directed the county attorney to prepare and file the documents.
The motion passed unanimously.
