County approves family transfer exemption to split 9.8-acre Frenchtown parcel into two 4.9-acre lots

Missoula County Commissioners approved the family transfer exemption requested by Lawrence and Pamela Kuldice to divide a 9.8-acre parcel at 11700 Fred Lane, Frenchtown, into two equal parcels of about 4.9 acres each. County planning staff presented the proposal and recommended approval after agency review.
Planner Katie Reeder said the parcel is designated rural residential and agriculture with a recommended density of one dwelling unit per two acres under the Missoula Area Land Use element. The applicants intend to transfer the south 4.9-acre portion to their adult son, who plans to build a single-family residence; the applicants will retain the existing home on the north parcel and do not plan further development there.
The county noted two technical constraints: Sunset West Water District reported strict water rights that prohibit additional public service connections, so the new parcel will need an alternative water source such as a private well; and Missoula County Environmental Health requires a sanitation review because the parcel is under 20 acres. Staff reported no rebuttable presumption of evasion and recommended approval. The applicants answered procedural questions on the record. A commissioner moved to approve the family-transfer exemption; another commissioner seconded and the board approved the motion by voice vote.
