Policy committee pauses Title IX-related student-records update after recent court ruling

The Wallingford School District Policy Committee on Jan. 14 deferred further action on revisions to policy 5125 (confidentiality and access to educational records) after the presenter said a recent Kentucky court ruling raises uncertainties about the 2024 Title IX final regulations.

Ms. Latour, a district staff member, told the committee that the policy revisions clarify that the district's Title IX coordinator is a school official with a legitimate educational interest when performing professional duties, reflecting the U.S. Department of Education's commentary to the 2024 Title IX final regulations. She said the revisions were intended to ensure the district's annual FERPA notifications list the Title IX coordinator as a school official.

Latour also reported that a recent court decision in Kentucky has created a legal question affecting how Title IX will be interpreted nationwide. "Within the last week, I think, Title IX has experienced a hiccup that could potentially challenge all 50 states' interpretation of the Title IX regulations," she said. Latour said the law firm Shipman Goodwin issued guidance advising districts to await further legal guidance and to seek legal counsel for any specific Title IX investigations.

Committee members agreed to delay the second read of policy 5125, with one member suggesting moving the second read from February to March to allow time for further legal clarification and for the district's counsel to advise. The presenter said she would update the committee as guidance becomes available.
