City staff told commissioners the permit was proposed as an alternative to vacating the right-of-way, following prior direction from the commission. The permit to occupy form requires a layout sheet (exhibit) that was not yet supplied; staff recommended approval contingent on receipt of that exhibit and indicated that existing engineering plans already in city files reflect the intended work.
City staff clarified that for the purposes of the agreement a paved parking lot or roadway is considered a “structure” under the permit definition; fences, roads and parking lots would therefore fall under that definition. The commission approved the permit by voice vote with the contingency that the appropriate exhibit be attached before final issuance.
