Deschutes County backs update to recreational-immunity law to protect county recreation sites, fairgrounds

County risk-management staff presented House Bill 3140 to Deschutes County commissioners on April 4 and recommended support. The bill updates Oregon’s recreational-immunity statutes and permits recreational providers to require users to waive some claims for ordinary negligence while preserving protections against waiving gross negligence claims.
County risk manager Eric said the statute’s evolution in recent years has eroded immunity protections and that the change would help county operations at properties such as the Deschutes County Fair and Expo Center and other county-owned recreation sites. Staff recommended a “priority 2” support position and asked commissioners to consider testifying or submitting letters in support.
Commissioners agreed the topic merited follow-up and asked staff to identify committee hearing dates and coordinate testimony. Staff said they would follow up on hearing timing and prepare to provide testimony.
