The Deschutes County Board of Commissioners on March 5 adopted Order No. 2025004 instructing county legal and planning staff to withdraw the respondent's brief filed with the Land Use Board of Appeals (LUBA) and ask LUBA for a timing extension to allow a limited de novo reconsideration hearing focused on issues raised by appellants.
Senior planner Nicole Mardell told the board the order would permit the county to seek a 180-day extension (rather than the standard 90 days) to prepare for a public reconsideration hearing on elements of the 2040 comprehensive plan update. The board voted unanimously to adopt the order and directed staff to coordinate with legal counsel to file the withdrawal and extension request with LUBA.
Mardell said the recommended hearing would be de novo but limited to the items identified in the respondent's brief, and staff will return with a hearing schedule should LUBA grant the extension.
Ending County staff said they would file the withdrawal and extension request with LUBA and return to the board with scheduling details and any further legal analyses.
