Board consents to dissolution of Eagle View Metropolitan District; homeowners associations will maintain streets

The Jefferson County Board of County Commissioners voted April 8 to consent to the dissolution of the Eagle View Metropolitan District after staff reported the district had repaid its bond debt and homeowners associations now own and maintain the subdivision’s streets and safety features.

Planning staff said the Eagle View service plan, originally approved Sept. 3, 2002, granted the district powers for street improvements, safety protection improvements (signs, hydrants) and mosquito control. Staff and the district’s representatives told commissioners the district exercised its powers, completed required improvements, and paid off the bonds it issued to build infrastructure.

Nick Nelson, the county planning manager and case manager on the matter, told the board that the service plan included a condition requiring an independent county determination that the district’s purposes had been achieved before dissolution. Nelson said the district’s streets were constructed by the district but not dedicated to Jefferson County; they were conveyed to homeowners associations for operation and maintenance under the recorded plat.

Attorney Maryann McGeady, representing the district, said the district had paid off its outstanding $2.4 million in bonds and had requested dissolution to avoid continued taxation of residents. McGeady also said Southwest Metro Water and Sanitation District provided a letter of support because it now operates limited public improvements that were dedicated to it.

No members of the public spoke at the hearing. The clerk recorded the vote as: Commissioner Kerr — Aye; Commissioner Zenzinger — Aye; Commissioner Dahlkemper — Yes. The motion passed and staff said any small remaining funds would be distributed equally to the homeowners associations per the district’s plan.

County staff will record the dissolution and complete required notifications.
