The Louisville Metro Board of Zoning Adjustment approved two conditional use permits permitting non-owner-occupied short-term rentals in predominantly residential zoning during the public-hearing portion of its annual meeting.
Case 24CUP0295: 711 Fountain Avenue Planning staff summarized the application for 711 Fountain Avenue, which is in an R-5 neighborhood-form district. Staff reported the dwelling has four bedrooms and a stated maximum occupancy of 10 guests, with off-street parking available in a driveway and a garage. The staff report noted no other short-term rentals approved by conditional use permit within 600 feet.
The applicant was represented by attorney Nick Pergolasco of Talbot & Roberts. Pergolasco and owner Gant Hill described the property as a renovated historic home with dual-access driveways and said experience managing other rentals would support professional operation and management. Pergolasco told the board the neighborhood meeting drew three or four attendees; initial concerns about parking and potential parties were addressed through the proposed management plan.
A board member moved to approve the conditional use permit, describing the application as meeting the standards in the Land Development Code and the staff report. The motion included the two conditions of approval listed on pages 7 and 8 of the staff report. The board approved the permit by roll-call vote; recorded votes showed five members voting yes and the motion carried.

Staff reported the house has three bedrooms and a stated maximum occupancy of eight guests; off-street driveway parking and an on-site garage were also noted, and staff again said there were no other short-term rental CUPs within 600 feet.
Owner-operator Lynn Thomas joined the meeting virtually and confirmed she lives four streets away and plans to manage the property. Thomas said an existing owner-occupied short-term rental she operates has all five-star reviews. The neighborhood association president, Brenda Royalty, said she had no opposition and introduced herself as a contact for the neighborhood.
The board moved to approve the conditional use permit with the two staff-recommended conditions. The motion passed by roll-call vote; recorded votes showed five members voting yes.
