Arapahoe County signals support for bill allowing death certificates to reflect a decedent’s gender identity

Arapahoe County commissioners voted to register a support position on a state bill that would require officials who complete death certificates to record a decedent’s gender in accordance with their gender identity, county staff told the board.

The bill, presented at the meeting as House Bill 25 11 09, drew a brief staff briefing from the county’s coroner. Coroner staff told the board that the demographic portion of the death certificate — which includes gender — is typically filled out by funeral homes in consultation with the family, while the coroner’s office completes the cause and manner of death portion.

Chief coroner staff said the county coroner’s office already strives to reflect a decedent’s gender identity and pronouns in reports and records when medical records or body identification permit it; the coroner’s office can and does override family‑provided information in some cases where staff have medical records demonstrating identity, the presentation said.

The coroner’s office also told the board that many of the practical issues the bill addresses are handled at local funeral homes and that the state Coroner Association had not taken a position as of the date of the memo. Boulder County was listed in meeting materials as supporting the bill.

Commissioners said the county’s coroner and staff had recommended a support position and the board recorded support for the measure in a thumb vote; county legislative staff indicated the bill is likely to progress through the legislature regardless of the county’s engagement but that a recorded support position would signal the county’s stance.
