Applicant Kristen Smith told the commission the state requires a base of operations for a mobile food or beverage vendor and that her operation will be limited — she described a mobile trailer used for lemonade with sinks for wash/rinse/sanitize and hand wash facilities on the trailer. Planning staff recommended approval with four conditions; commissioners added a fifth condition granting a variance to allow an existing accessory structure to sit 39 feet from the left property line rather than the required 50 feet as shown on the submitted site plan.
Smith said the operation does not include food preparation beyond simple beverage service and that the conditional use is intended primarily to satisfy state regulations (she referenced House Bill 1404 in describing updated state requirements). No one spoke in opposition during the public comment period.
The Planning Commission’s decision is final unless appealed to the Board of Commissioners; because this was a conditional use the item may still be subject to appeal at the Board’s public hearing in May.
