At the March 27 meeting the commission reviewed the file request submitted on behalf of Lewis L. Gambardelli. A staff member reported that site observations — including a follow-up sidewalk visit by commissioners — found the lot unchanged from the period covered by the original order and that several small, preexisting sheds remained.
A commissioner read the certificate language into the record: “It is hereby certified that the work regulated by the above referenced order of conditions never commenced. The order of conditions has lapsed and is therefore no longer valid. No future work subject to regulation under the Wetlands Protection Act may commence without the filing of a new notice of intent and receiving a new order of conditions.”
Following that reading a motion to issue the certificate of compliance was made and seconded and carried by voice vote. Commissioners did not specify vote counts on the record.
The commission’s action closes the earlier file; any future regulated work at 117 Mishawam will require a new filing under the Wetlands Protection Act.
