Council lays over rezoning for 2009 S. 7th St. after neighbor concerns; developer to be asked to attend next hearing

Neighbors who live adjacent to the property raised concerns about the effect on a four-foot retaining wall at the shared property line, potential stormwater runoff toward nearby foundations, loss of permeable surface and the lack of developer contact with the immediate community. Nate Koenig and Kelly Enriquez testified that they had been unable to identify or reach the project owner and asked for clearer information about site plans.
City Planning staff told the council that rezoning is a legislative matter and that a site plan is not required to be submitted with a rezoning application; staff noted that rezoning from GC (General Commercial) to R7 is effectively a downzoning to a residential use. The council discussed whether the developer had been asked to submit a revised site plan; council members said updated site plans would assist neighbors and the council’s review.
Council action: after discussion, Councilmember Hugg moved to lay the item over for 30 days and continue the public hearing; a motion (subsequently aligned to the council’s schedule) to lay the item over to April 29 passed by roll call 7–0. Councilmembers urged planning staff to notify the developer and request their attendance at the continued hearing.
What’s next: the item will return April 29; staff and council requested the developer meet with neighbors and, if possible, supply a revised site plan or additional details before the continued hearing.
