Committee advances A4006 to let registered partners and joint ventures bid on certain public works projects

The committee released A4006 as amended, changing state procurement rules to permit partnerships and joint ventures to bid on public works and prevailing-wage contracts when each party to the partnership or joint venture is independently registered.
Committee amendments narrow the types of public works and prevailing-wage contracts that may be bid by such partnerships to projects defined as heavy, highway, utility, marine, transit, environmental remediation, and related infrastructure projects or any project for which payment of prevailing wage is required by law. The amendments also provide a definition of “heavy infrastructure project.”
Ryan Sharp, director of government affairs for the Utility and Transportation Contractors Association, testified in favor, describing a court decision that had prevented some joint ventures from bidding when the joint venture itself lacked a public works certificate despite each partner being certified. Sharp said the bill closes that timing loophole while preserving prevailing-wage and certification protections.
The committee moved and released the bill as amended on a recorded vote.
