The Highland Village City Council voted 6–0 on Feb. 11 to grant a conditional use permit (CUP) and approve a site plan and elevations allowing an accessory dwelling unit at 260 Meadowlark Lane in the Anderson Estates subdivision.
City staff presented the request and said the accessory dwelling would let the property owner house an additional relative on site. The property is zoned SF‑15 and staff said the application met the city’s zoning and ordinance requirements. The Planning and Zoning Commission considered the item on Jan. 21 and recommended approval by a 5–0 vote; the city had received no public inquiries on the item as of Feb. 10.
Council discussion focused on the CUP’s duration and what would happen on sale or nonuse. The city attorney confirmed the ordinance contains a termination provision: if the accessory dwelling use ceases for a set period (the ordinance specifies 180 days of nonuse) the CUP expires. The attorney also noted that the CUP can terminate if the owners do not proceed with construction within the approved time frame. Under current ordinance language the accessory dwelling is restricted to related occupants (family) and the city treats unauthorized subdivision or separate sale of the property as an illegal subdivision should someone attempt to use the CUP to create a separate legal lot.
Councilman Nelson seconded the motion to approve the ordinance; the motion carried six‑zero on first reading.
