Commission approves conditional-use permit for accessory dwelling at 260 Meadowlark Lane

The commission voted unanimously to approve a conditional-use permit (CUP) allowing an accessory dwelling unit (ADU) on Lot 1B, Block A, Anderson Estates, commonly known as 260 Meadowlark Lane.
Autumn Amen, community development coordinator, briefed commissioners that the property is zoned SF-15 and is approximately 2.67 acres. She said the proposed ADU would measure 2,017 square feet while the main structure is 4,778 square feet, and that “per ordinance, an accessory dwelling shall not be more than 50% of the main dwelling, therefore they do meet the standard needed.” Amen also said notices were mailed to properties within 200 feet and staff received one phone inquiry that raised no objections.
Property owner Josh Benters said the new unit will tie into existing utilities. “All of the utility comes down that long panhandle driveway there and terminates, about 20 feet in front of my front door in the front yard. So the new driveway will pass right in front of that utility, and it'll just extend down fiber gas and electricity from where it's at,” Benters said.
Amen told the commission that the ordinance includes termination provisions and reiterated that ADUs may not be leased or separately metered for water, gas or electricity. She said if the property were ever sold and the owner wished to divide the parcels, the owner would have to replat the property and meet subdivision and zoning standards.
The public-comment period opened at 7:09 p.m.; no members of the public spoke. A motion to approve the CUP was made and seconded and passed on a unanimous voice vote. Commissioners present voted in favor; the record shows the motion passed unanimously.
Documentation included the ordinance prepared by the city attorney, site plan and building elevations filed for reference. The file notes the application includes the zoning ordinance section governing ADUs.
