Planning staff presented the request and recommended approval with conditions listed in the staff report; the commission’s action followed clarifying questions about site location, frontage improvements and access. “This property is currently zoned general commercial,” Mr. Page, a planning staff member, told commissioners, and the use requires a conditional use permit in that zone.
Commissioner Jensen pointed out an apparent mapping error in the packet and asked which lot was the actual site; staff confirmed the correct location is the lot just east of Home Depot. Commissioners also asked whether curbing and sidewalks would be required on the private access drive. The commission was told staff is requiring the applicant to construct curb and sidewalk along the site frontage.
City engineer Mr. Hatzal explained the access drive is covered by a recorded cross-access easement created when Home Depot was developed. “As far as maintenance, it’s the responsibility of the individual property owners. It’s not the city's responsibility to plow or maintain,” he said, and added the commission’s code requires private streets to be constructed to Tooele City standards (curb and gutter, sidewalk, lighting and similar elements).
Commissioner Hammer asked about building materials and whether the proposed elevations matched other nearby commercial standards; staff noted there are no architectural standards currently required in that North Gateway area and that the CUP is not a site plan approval, so the commission’s review is limited to the conditional use criteria.
The motion to approve the CUP by Halley Properties LLC (application number 2025026) passed 6-0; the roll call recorded aye votes from Commissioners Hammer, Proctor, Hamilton, Jensen, Anderson and Sloan. The commission’s approval authorizes the use; final site plan approvals and any required property-owner authorizations remain separate processes.
Staff noted property owners around the site were notified in accordance with state and local notification requirements.
