At the March 6 Lincoln City Council meeting a resident reported repeated spring and rain flooding to a yard at 119 Clark Road and said snow removed from nearby new development had been pushed onto her property instead of hauled away.
The resident asked where to take the complaint. Council and staff explained that whether the city has enforcement authority depends on the type of easement affecting the properties. City Attorney Greg and staff said drainage issues that arise from a public right‑of‑way or a public easement can be a city enforcement matter; if the drainage arrangement is a private easement between parcels (a burdened parcel accepting runoff from a benefited parcel), the dispute is typically a private matter between property owners.
Public works staff said the city and the developer, Verity Homes, had previously agreed that snow from the subdivision would be removed and not pushed onto rear yards because of drainage concerns; staff suggested the resident first raise the issue with the developer and noted the city could help facilitate communication. Staff said the city had asked Verity Homes to remove snow to the boulevard and spread it there rather than pile it where it impedes drainage.
The council advised the resident to review title records and plat maps to determine whether the drainage feature is a public easement; staff suggested the county recorder as the place to check recorded easements and offered to follow up on the city’s side regarding the developer agreement for snow removal.
No formal action or ordinance change was taken; staff will follow up with the resident and with Verity Homes if the developer is not meeting the previously reported agreement about snow removal routing.
