Authority names Chris Kane to technical dispute review board; RRVA names Randall Hoffner

General Counsel Mr. Shockley briefed the Metro Flood Diversion Authority on March 27 on the status of the Technical Dispute Review Board (TDRB). He said three prior members resigned and that the board has appointed Chris Kane as the authority’s member on the TDRB. RRVA has named Randall Hoffner as its member.
Shockley described the TDRB as operating similarly to an arbitration panel: the two appointed members will select a third, independent chair. He said the parties will submit potential chair names but that the two panel members will pick the chair to maintain independence.
Shockley told the board he expects the panel to include three attorneys, probably with engineering backgrounds, because potential candidates with only technical backgrounds were less comfortable operating under open-meetings requirements. He said the composition reflects counsel’s view that legal practitioners are generally more experienced operating under the constraints of open-meetings law and conducting hearings.
