Hearing Examiner continues two enforcement cases, dismisses one and signals penalties for utility shutoff case

The City of Bremerton Hearing Examiner on March 24 considered four code-enforcement matters. The examiner granted continuances on two cases, dismissed one matter as cured, and signaled monetary penalties in a fourth case involving lack of water and trash service at a rental property.
For NOV C230556, issued to Janet and Nicholas Gargewell for property at 815 Shore Drive, the city requested and the examiner granted a continuance to the May 27, 2025 hearing so the owners could continue work with a hired geotechnical engineer. For NOV C210025, issued to Georgia Bullcock for properties at 543 and 545 Sixth Street, the examiner granted a continuance to May 27 after the owner scheduled a city pre-submittal meeting for March 26 and requested time to progress permitting.
The examiner found the third matter, C240547 (listed to Roberto G. and R Fundozo trustees for property at 803 Warren Avenue), had been cured after the owner submitted a demolition permit application and obtained a sewer cap; the examiner dismissed that NOV at the hearing.
The final matter, C240609, involved a property for which city exhibits documented repeated water shutoffs and lack of trash service. Felicia Breu, senior accounting assistant in the City of Bremerton billing office, testified that water service had been shut off for nonpayment on Aug. 7, 2024; the meter was relocked Aug. 15 after evidence of tampering; service was temporarily restored Sept. 6 for a heat advisory and then shut off again Sept. 11, 2024; and there has been no subsequent contact or payment arrangement recorded. Assistant city counsel reported Waste Management and Bremerton water-records exhibits in the file.
The city recommended the usual enforcement timeline and penalties: a two-week compliance period, an initial fine of $500 and $100 per day thereafter. The hearing examiner said he was inclined to find the violation occurred and to impose monetary penalties consistent with the discussed schedule and said he would issue a written decision in the next couple of days.
All continuances were scheduled to the May 27 hearing date; the dismissed case was recorded as cured in the hearing record. The examiner will issue written orders for the two continued cases and for the utility-shutoff matter, specifying any fines, compliance deadlines or further remedies.
