The Shelbyville Beer Board on Wednesday deferred consideration of an on‑premises beer permit application from Theresa Cruz, the applicant for Happy Times at 1014 Madison Street, after staff and board members found required information missing from the file.
Board members and staff told Cruz during the hearing that portions of the application lacked addresses and a signed consent or lease from the property owner. City staff also asked for a certificate or statement from the health department that covers the requirements of section 8‑223 of the municipal code and said building and lease paperwork had not been provided for review.
City staff member Lisa Wilcox told the board, "Also, we will need something from the owner of the property," while explaining what was missing from Cruz’s packet. The board swore in Cruz with a Spanish‑language translator, Alejandro Bernstein, who agreed to translate testimony for her.
Cruz and the translator said she has not previously held a beer permit and that the business would operate as a restaurant serving American‑style food. Cruz told the board she is renting the property and does not own it. Staff noted corrections needed in several application fields (addresses for sections 2 and 6, a clearer response to whether the applicant will conduct the business in person, and a consent letter or lease allowing alcohol sales at the location).
Because of the missing and unclear documentation, a board member moved to postpone consideration until the next meeting. The motion carried on a voice vote: "Aye." The board asked Cruz to return with the corrected application, a signed lease or owner consent letter, and the health‑department certificate; staff said the applicant may make edits at City Hall with Miss Lisa prior to the next meeting.
The board set the next opportunity for the application as the Beer Board meeting scheduled for Wednesday, May 14. Cruz was told to bring the requested paperwork and any additional evidence (for example, health‑department documentation or the owner’s consent) when she returns.
For the record, staff confirmed Cruz said she understood the beer rules and the ordinance provisions discussed during the hearing.
