At the meeting, commissioners debated two competing priorities: moving quickly to capture developer interest in an uncertain financing environment, versus casting a wider net to ensure the CRA receives a full set of proposals. Attorney Chris Smith told the board a state statute governs the unsolicited-proposal process and staff confirmed the notice-of-disposition approach was authorized by the CRA's November 2024 direction.
After discussion, the board approved a motion directing staff to prepare an addendum, if legally possible, to extend the notice from 60 to 90 days and to publish nationally. The motion passed 4-1 (Commissioner Davis Paneer: yes; Commissioner Guyton: yes; Vice Chair Mila Anderson: yes; Commissioner Spiritis: no; Chair Shirley Lanier: yes). The motion included instructions for staff to coordinate with procurement and legal counsel on the mechanics and to report back in writing on whether the extension can be implemented without reissuing the entire solicitation.
Procurement staff said extending an open solicitation's deadline is done by issuing an addendum that amends the closing date; staff also said the notice had been advertised in the Palm Beach Post and regional outlets and that national publication could be added to future outreach. Legal counsel agreed to research statutory constraints and provide a written confirmation to the board about whether the extension and expanded publication comply with the relevant statute.
