Buena Vista — The Town of Buena Vista Board of Trustees on April 8 reapproved a permanent encroachment permit for Clearview Community Church, allowing an existing deck, chimney, light fixture and a rock planter wall to remain within the public right‑of‑way.
Background and request The church property included previously permitted encroachments dating to 2008. When ownership transferred, town staff discovered that certain administrative requirements (insurance naming the town as an additional insured/losspayee) had lapsed. The church sought reauthorization and supplied updated insurance and documentation.
Staff review and findings Public Works staff reviewed the encroachments and found no public‑safety obstructions and no planned right‑of‑way work in the next 48 months that would conflict with the encroachments. Staff therefore recommended approval with the usual conditions: updated insurance, maintenance responsibility by the property owner and a town right to revoke the permit if future public‑works projects require the space.
Board action Trustees adopted the encroachment permit (recorded in the meeting as Resolution No. 25); the vote passed by majority voice vote in the meeting transcript (no roll‑call tally recorded). The permit is revocable if the town later needs the right‑of‑way for public improvements.
Quote “We took it,” Francie Crowder of the church said, explaining the property transfer and why the organization asked trustees to renew the permit.
Next steps Town staff will record the encroachment permit conditions, confirm insurance and monitor right‑of‑way plans; if the town later requires the right‑of‑way, staff said the permit may be revoked or adjusted with compensation/relocation measures if required.
