Vermont committee hears sharply divided testimony on S.50 change to net‑metering expedited registration

The House Energy and Digital Infrastructure Committee spent the afternoon on April 8 taking testimony on S.50, a bill that would raise the size threshold for expedited net‑metering registration from 15 kilowatts to 25 kilowatts for small ground‑mounted systems.
The bill’s proponents — local solar contractors and developers — told the committee the change reflects technological gains and customer demand for larger systems to serve heat pumps and electric vehicles. Andrew Cunningham, director of sales and business development for Southern Vermont Solar, said, “I think it is a excellent step in the right direction.”
Supporters argued that modern panels produce more energy in the same footprint than a decade ago, that many homeowners now add heat pumps and electric‑vehicle charging, and that the higher cap would let small installers deploy systems faster. Jared Cobb, general manager of Catamount Solar, said the measure would “allow us to deploy more clean energy, to respond to the climate crisis, to help Vermonters with their utility bills,” and described his worker‑owned cooperative’s local footprint and customer base.
Municipal utility and operations witnesses urged caution. Brian Evans, village manager for the Village of Hyde Park and manager of its electric utility, described Hyde Park as a small, vertically integrated utility with roughly 1,400 electric customers, seven staff, a 3‑megawatt peak load and about 1.5 megawatts of behind‑the‑meter generation. He told lawmakers he does not oppose solar generally but warned that an expedited registration process could require his small staff to reprioritize other essential work: “We are not objecting to the what's in place today. We understand the process that's in play today. We just don't want to have more on top of that become accelerated.”
Evans said Hyde Park has a queue of about 15–25 projects awaiting a technical substation upgrade and is preparing a net‑metering tariff and a cost‑recovery mechanism to pay for the infrastructure work. He also described equity concerns: customers who can afford to build distributed generation already receive tax incentives and other benefits, and faster registration could further advantage higher‑income customers.
Several presenters raised implementation details the committee will need to consider if the bill advances. Evans and other utility‑adjacent witnesses urged clearer interconnection sequencing, asking that project applicants file interconnection requests with the interconnecting utility no later than the registration filing so utilities are alerted and can perform technical reviews in a predictable order. Evans also noted Rule 5.1’s “interconnection reliability assessment” and said the rule’s encouragement that applicants also file interconnection requests is not consistently enforced in practice.
Installers urged the committee to reject an amendment that would subject these small ground‑mounted systems to municipal setback rules. Multiple contractors said towns already have varying and sometimes complex setback rules that would add delay and cost. Jared Cobb said the setback amendment would add “red tape and additional regulations” that would slow installations; Catamount and other installers said they already check with towns and generally self‑police siting and aesthetics.
Contractors and developers also described market behavior created by the 15‑kW cap: many customers stop at the lower threshold to avoid a slower, costlier review, and contractors said that has limited deployment. Catamount reported that, in recent years, only 11 systems between 15 and 25 kW had been built in Vermont compared with hundreds under 15 kW. PowerGuru CEO Alexander Mintz said the higher limit would be “tremendously beneficial for a lot of our customers,” particularly new homes and electrifying households that need more generation.
On technical limits, witnesses and committee members discussed inverter sizing, substation configuration and battery storage. Hyde Park’s upgrades are intended to address voltage and protection issues that currently prevent some queued projects from interconnecting; Evans estimated the immediate substation work would be finished within months. Installers said batteries are increasingly paired with solar and can reduce daytime exports, though some witnesses said battery economics and fire‑safety considerations still shape uptake.
No formal action or vote on S.50 was recorded during the hearing. Lawmakers said they will continue to gather testimony and data, including technical guidance from the Public Utility Commission and details about how municipal setbacks, single‑plant rules, and interconnection sequencing would be applied if the expedited cap is raised.
The committee scheduled additional testimony and indicated staff will compile a chronological list of witnesses and written submissions for members to review before deliberations.
