Committee removes appropriation from parole/probation fee bill; policy provisions remain

The Appropriations Committee amended House Bill 1417 to remove a $310,000 appropriation related to indigent defense or fee-replacement funding and left the bill's policy provisions in place. Senator Connolly explained the amendment, saying the bill “has to do with reentry, specifically the indigent defense services and... fees and reimbursement of indigent costs and expenses.”

Committee members discussed the fiscal note and where the removed appropriation would be addressed; staff explained the appropriation had been included in the Department of Corrections and Rehabilitation (DOCR) budgets or in the legal indigence budget. Staff clarified the fiscal note still shows revenue reductions and expenditure changes tied to fee removals and other program shifts: a projected $340,000 in general fund revenue reduction and $1.8 million in other funds revenue reduction remain on the fiscal note, along with an expenditure increase of $1.5 million in the general fund offset by a reduction in other funds.

Senators said some fee-waiver components were sensible, while other policy changes in the bill (granting DOC additional discretion) were more substantive and might require separate review. The amendment removing the appropriation passed (committee recorded as 16 yes). The committee then approved HB 1417 as amended; the final due-pass-as-amended vote was recorded as 14–2.

Committee discussion directed the remaining policy and fiscal interactions to relevant committees; the sponsor indicated the portion requiring appropriation will be reconciled elsewhere (DOCR or indigent defense budgets) during ongoing budget work.
