Manvel commission tables freestanding ER at AutoZone site pending hours clarification

The Manvel Planning, Development and Zoning Commission on March 10 voted 7-0 to table its recommendation to city council for a proposed freestanding emergency department on a roughly 1.07-acre tract west of the under-construction AutoZone at 19201 Morris Avenue so staff can clarify operating-hour requirements.

Commissioners asked whether a freestanding emergency department must be open 24 hours under state licensure. A speaker identified in the hearing as clarifying state licensure said, “under the state licensure, in order to apply for a freestanding emergency medical care facility, you are required to be open 24 hours a day. Right. 365 days a year.” Staff and the applicant said they needed time to resolve an apparent conflict between predetermined local conditions in the city's ordinance (which list operating hours of 8 a.m. to 10 p.m. for certain medical uses) and the state licensing requirement that a licensed freestanding emergency facility operate continuously.

The applicant's architect, Alan Swift, told commissioners the site has an existing TxDOT driveway cut and that the project team is coordinating driveway-location adjustments with TxDOT. The applicant also said there would be no helicopter pad and that the approved driveway would allow site access without driving through neighboring businesses.

After discussion, a commissioner moved to table the item for additional review of the operating-hours issue; the motion carried 7-0. The item will return to the commission after staff and the applicant clarify applicable state licensure and how that requirement interfaces with local ordinance conditions.

The commission recorded the action as a tabling of its recommendation to city council; no formal vote on the zoning or specific-use permit was taken.
