ZBA approves cold-storage addition at South Main Street, requires signed planning-board site plan

The Wolfeboro Zoning Board of Adjustment on a motion approved a special exception allowing a 33-by-12-foot cold-storage addition at a South Main Street commercial property, case 03SE-25, with the condition that the applicant return to the ZBA with the planning board’s signed site plan for the board to attach to its approval.
The board’s action followed a continued public hearing in which the applicant said the addition would sit at the rear of the existing building and be used as unheated cold storage with no plumbing or HVAC. The applicant and members discussed site features, including the proposed stone trench for runoff, propane tank location, dumpster location, snow storage, and the location of a test pit on the overall plan submitted to the planning board.
Board members pressed for a final, stamped site plan to which the ZBA could attach conditions and file with the registry of deeds. The board read minutes and the planning-board notes into the record showing the planning board’s conditional approval language and requirements for stamped drawings. With those items in mind, a motion was made and seconded to approve the special exception “with the condition that the applicant return to the ZBA for review of the planning-board signed approved site plan.” The motion carried on a roll-call vote. The ZBA chair said the applicant must appear before the planning board and then return for the ZBA to review the planning-board-signed document before the ZBA will sign its approval for recording.
Why it matters: The board’s condition preserves its ability to confirm the planning board’s required amendments — including professional stamps and specific site-plan elements the planning board required — before the ZBA’s approval is finalized and recorded.
The board recorded the vote in public and advised the applicant to secure planning-board sign-off and return to the ZBA. The ZBA also noted that if the planning board makes substantial changes to the site plan, the applicant must return to the ZBA for further review.
