The Greenacres City Council approved Ordinance 2025‑01 on first reading to amend the city zoning code, extending deadlines for variances and site-and-development plan approvals and clarifying what the Development Review Committee (DRC) can review.
The change aims to align local practice with state law and reduce redundant notices while tying approvals to actual building activity. Planning staff said the amendment lengthens variance time frames to one year (from six months), links variances and special exceptions to the active status of the required building permit, and revises administrative-variance procedures so nearby stakeholders may register objections that would escalate a case to a regular variance review.
According to staff, the DRC’s clarified authority will explicitly include review and recommendation of live-entertainment permits, master sign plans and PLAAFPs (as listed in the amendment). The site-and-development plan rules were updated to require approval for all new structures except single-family homes and duplexes on established lots; the code now requires colored renderings, a justification statement and, where applicable, plans for public art. The amendment also establishes a two‑year approval window for site-and-development plans tied to issuance of all necessary building permits and allows up to two one‑year extensions in limited circumstances.
Staff told the council the administrative-variance section was rewritten to mirror the updated variance language and that the DRC reviewed the amendment on Jan. 16, 2025 and recommended approval. Legal review and a city-code criteria finding were noted in the staff report, and planning staff recommended adoption as presented.
Council members asked whether multiunit developments (for example, attached townhomes) would need a single, communitywide permit or individual permits for each unit; staff clarified that previously approved exceptions for original sections (older neighborhoods) remain in place and that the site-and-development plan pathway still applies to major developments. The council voted to approve the ordinance on first reading by voice vote.
The ordinance moves to a subsequent reading before final adoption.
