Applicant John Dacco presented the request and staff explained agencies consulted raised no objections provided drainage would be managed elsewhere inside the easement. Planning staff told council an as-built swale exists per the recorded site plan even though the applicant's photos suggested otherwise; staff recommended approval conditioned on the permit and construction to maintain drainage within one year.
Resident Stan Johnston urged that council require sufficient engineering documentation before making a decision. Councilmember Stockel asked staff to confirm the condition; staff confirmed the resolution calls for the vacation to be held in escrow and not recorded until the permit and realignment are in place.
Council moved to approve the vacation with the stated condition; the motion passed unanimously.
