Council approves rezoning change at Windover Farms, removing earlier binding concept plan despite neighborhood opposition

The Titusville City Council approved Ordinance 12-2025, removing multiple previously-adopted conditions and a binding concept plan that governed a 25.9-acre portion of the Windover Farms property in order to let the owner develop under the standard Regional Commercial (RC) regulations.
The matter was heard as a quasi-judicial rezoning. Staff's report summarized the history: the property had been rezoned in 2008 with a binding concept plan covering contiguous parcels that included adjacent land not owned by the current applicant. Brad Parish (planning staff) told council the prior conditions required a binding concept plan, development agreement, and certain screening and traffic-study review steps, and noted some conditions duplicated statutory or agency requirements. Applicant Cole Oliver asked council to remove the conditions, saying the prior multi-parcel concept plan could not be executed because the adjacent parcel was not under the applicant's control; he offered to limit traffic to the same trip generation already approved under the older concept plan and to limit access points to those already depicted.
Multiple Windover Farms residents testified in opposition. Sandra Klinger and other neighborhood speakers argued removal would decouple the site from the adjoining parcel that provided direct arterial frontage on State Road 50, creating noncompliance with LDR minimum lot-width/frontage expectations for the RC district and risking high-intensity commercial traffic onto the narrower Windover Way local road. They urged the council to preserve the previously-approved constraints or require a different zoning category more appropriate for a parcel without arterial frontage.
Council discussed statutory and code interpretations including the phrase "frontage on an arterial roadway," definitions of "frontage," functional road characteristics, and whether practice elsewhere in the city had produced similar configurations. Several councilmembers said the RC zoning already matched the comprehensive plan's commercial-high-intensity land use for the corridor. After debate, council adopted the ordinance removing the prior conditions and concept plan by a 4-1 roll call: Mayor Andrew Connors, Vice Mayor Cole, Member Stochel and Member Nelson voted yes; Member Muscosa voted no.
Ending: The ordinance removes the 2008 concept-plan conditions so the applicant can develop under the city's RC standards; development proposals will next be subject to normal site-plan review, traffic study requirements and permitting.
