Planning board backs ban on for-profit "party" promotions at single-family homes

The Miami Beach Planning Board on April 8 voted to transmit to the City Commission an amendment tightening rules against using single-family homes for commercial events, including a prohibition on paid promotions and public advertising of such events on social media.
Staff explained the amendment would "strengthen the prohibition" on using a single-family dwelling for commercial purposes and would bar for-profit sponsorship of events at homes. The draft text would allow exceptions only for charitable, religious or political organizations with tax-exempt status when those entities comply with election laws.
Board members discussed enforceability and sought assurances the measure would not sweep up private, noncommercial gatherings such as family birthday parties. Board members emphasized the difference between a private invitation and broadly advertised, for-profit events. As one member put it during discussion, "there's a difference between posting an event on social media and inviting your friends and family versus posting a special event on social media and opening it to the public." Staff said a separate amendment to the special-events code sets thresholds (for example, 100 attendees) that would trigger a formal special-event permit process.
The board voted in favor of transmitting the land-development regulation amendment with a favorable recommendation. The separate special-events thresholds will be considered under a separate code amendment the board discussed in the same meeting.
