Board grants six-month extension for conditional use at 18 S. Belmar Drive

The Pataskala City Board of Zoning Appeals on April 8 approved a six-month extension to a previously granted conditional use for 18 South Belmar Drive, allowing the applicant additional time to obtain permits and complete required building improvements.
The extension preserves conditional use CU-24-006 under Section 12.15.09 of the Pataskala Code, which states that a conditional use becomes void if not carried out within six months of approval but allows a single six-month extension. The board approved the extension with conditions that require the applicant to carry out the conditional use within six months, obtain all required permits and inspections from the city and the Lincoln County Building Code Department within one year, and address comments from planning staff, the water district and the West Joint Fire District.
Jack (planning staff) told the board the conditional use was approved Aug. 13 of the prior year and that delays were attributable to obtaining architectural plans and completing required improvements. Mark Schuster, who identified himself as the landlord, told the board that the project team had submitted architectural drawings but that Lincoln County Building Code had since asked for structural engineering drawings. "The hold up now is they had indicated that, in addition to the architectural drawings ... they want structural drawings now from an engineering firm, and so I have filed an appeal," Schuster said. He added he did not expect the appeals process to prevent completion within the requested extension.
The motion to grant the extension included the three conditions read into the record: carry out the conditional use within six months pursuant to Section 12.15.09 of the Pataskala Code; obtain all necessary permits and inspections from the City of Pataskala and the Lincoln County Building Code Department within one year; and address comments from planning and zoning staff, the water district and the West Joint Fire District.
The board voted to approve the extension. The roll call recorded the motion as approved (members recorded as voting yes: Ms. Collins; Mr. Vander Rea; Mr. Howe; Henderson; Mr. Hubert).
