Special magistrate finds Johnsons in violation for unpermitted RVs; one case continued, one removed

The finding came at the town's April 7 code enforcement hearing after Code Compliance Officer D'Angelo Campo testified that an inspection on March 31, 2025 found two RVs on the Johnson property without a permit or affidavit. "It is recommended that the respondent be given until 05/07/2025 to correct the violations or be charged a fine not to exceed a hundred dollars per day for each day the violation continues to exist," Campo said. He also recommended administrative costs of $234.05.
Barnard said she would receive the town's evidentiary case file into the record for purposes of the hearing and that service was sufficient. "I'll find the town had good service for today's hearing," Barnard said, and she announced her ruling that the respondents were in violation. Barnard ordered the Johnsons to comply by 05/07/2025; if they do not, she scheduled a fine-assessment hearing for 05/21/2025 at 9:00 a.m. and authorized a fine of $100 per day for each day the violation continues, plus the administrative costs assessed.
Earlier in the hearing the town presented two other matters. A case involving property at 12891 Collecting Canal Road was continued at the request of the town's presenter, John Suarez; Barnard reset that matter for a violation hearing on May 5, 2025 at 9:00 a.m. The first case on the agenda, involving Cheryl Marlo, was removed from the agenda after the respondent submitted an RV affidavit.
No respondents were present in the hearing room for any of the cases. The magistrate adjourned the brief session at about 9:12 a.m. on April 7. The town's code compliance office provided the case materials and photographs that formed the evidentiary basis for the Johnson ruling.
