The East Troy Village Board approved two right-of-way privilege agreements for properties affected by the School Street project: 2843 School Street and 2054 Division Street.
Staff explained the School Street project required adjustments to several nonconforming driveways and that the village amended its ordinance to allow replacing existing nonconforming driveways in kind. Both property owners have signed the right-of-way privilege agreements; one driveway has been installed, assessed and paid for, while another approach is not yet installed and the property owner has said it will be installed when weather allows.
Board members noted an administrative detail: one owner notarized the agreement in Hawaii, and the signed document was mailed to the village so the signature could be recorded with the county; as a result, the trustee whose signature was required could not sign that night. Trustee Holmes moved to approve the agreements; Trustee Nugent seconded and the motion carried by voice vote with all members voting in favor.
Staff and trustees said the experience offered a lesson about processes used when property owners install their own driveway approaches and whether future ordinance language should address those situations.
