Superintendent tells board Dane County judge struck parts of 2011 Act 10; district awaiting guidance

During the superintendent’s report Dec. 9, Dr. Robinson told the West Allis-West Milwaukee School District Board that a Dane County judge has struck down portions of 2011 Act 10 that affected collective bargaining for some public employees.
"A Dane County Judge has restored collective bargaining powers for public employees who lost them under 2011's Act 10," Dr. Robinson said, summarizing the judge’s finding that the statute treated some public safety employees differently from others. He said the district has consulted with its attorneys and been advised to wait before changing local practices.
"We've been told, hold off. No changes. Just try to figure out and let things come out," Dr. Robinson said, reflecting the district’s current approach while legal and practical implications are clarified.
The superintendent said the law originally limited negotiations for general employees to base wage increases tied to the Consumer Price Index and that the court’s ruling removes or alters parts of that framework for affected employees. District staff said they are monitoring the situation and will update the board once the legal picture is clearer.
No formal changes to district collective bargaining or payroll practices were announced at the meeting.
