ConVal board rescinds 2024 Title IX rule adoption, restores 2020 regulations and updates policy

The Contoocook Valley School Board on Jan. 20 moved to rescind a Title IX policy adopted under the U.S. Department of Education’s 2024 regulations and to implement the 2020 Title IX regulations after a federal court ruling made the 2024 rule unlawful nationwide.
The district’s policy update followed a staff presentation that cited a U.S. District Court for the Eastern District of Kentucky decision that “vacated” the 2024 Title IX regulations, which the presenter said made those 2024 regulations “immediately unlawful nationwide.” The board then adopted the version of policy ACAC aligned with the 2020 regulations on second read and rescinded the district policy that reflected the 2024 regulatory text.
Superintendent-level staff and board members discussed the immediate steps needed to ensure district compliance across all schools. The presenter said the district had already begun implementing elements of the 2020 framework at three schools and would make the 2020 approach consistent districtwide. The board voted in favor of adopting ACAC under the 2020 Title IX rules.
Separately on policy, the board approved KFD, a district policy governing the use of automated external defibrillators, on second read.
Board members asked procedural questions about rescission versus automatic nullification following the court order; staff told the board they would formally rescind the 2024-based policy and place the finalized 2020-aligned policy on the district’s policy roster. The board approved both the adoption of ACAC (2020) and the KFD AED policy by voice vote.
The board’s actions mean the district will carry out investigations, definitions and procedural requirements under the 2020 Title IX regulatory framework going forward. Staff said one small textual change in the ACAC policy removed a parenthetical list of protected characteristics and replaced it with a reference to the Title IX definition.
