Commission approves consent agenda, denies one tax-fee waiver; passes park-naming policy and prosecutor invoices

The commission approved the consent agenda, which included 391 invoices totaling $595,256.90 and several board reappointments and contract renewals, by a 5-0 vote. Commissioner Johnson moved to approve the consent agenda; the motion passed unanimously. Specific consent resolutions listed in the meeting packet included Resolution 2025-75 (invoice payments), Resolution 2025-77 (renewal of the Jesse James Bank Museum lease with Old Farm Holdings LLC for the parks department), Resolution 2025-79 (renewal of property and casualty insurance with Travelers Insurance and Chubb), Resolution 2025-74 (reappointment of three members to the Clay County Economic Development Council board), Resolution 2025-81 (reappointment to the Airport Advisory Board), and Resolution 2025-80 (reappointment of three members to the Planning and Zoning Commission). The consent agenda passed by voice vote and a roll call recorded as 5-0.
On Resolution 2025-41, a request by Thomas and Julia Randolph for a waiver of interest, penalties and taxes, the commission denied the waiver. The motion to deny Resolution 2025-41 was made by Commissioner Johnson and passed 5-0 after commissioners questioned the applicant about mailing dates and noted the check and the county postmark showed January 3, after the December 31 due date. County legal counsel told the commission state law allows waivers only if the county made an error or omission and referenced language in Chapter 137 requiring, in some cases, a postmaster statement to substantiate a postal error. The applicant, Julia Randolph, said she mailed payment on December 30 but had no documentary proof.
Resolution 2025-76, approving nine invoices for the Clay County Prosecutor’s Office totaling $1,541, passed with four votes in favor and one recusal (Commissioner Thompson recused); Commissioner Johnson moved approval. The roll call showed four yes votes and one recusal.
Resolution 2025-82, a policy to govern the naming of Clay County parks, land and facilities, passed 3-2. Commissioner Wagner moved to approve the policy. Commissioners Wagner, Thompson and Carpenter voted yes; Commissioners Johnson and Lawson voted no. In debate ahead of the vote some commissioners said they opposed naming public assets after individuals out of concern that wealthy donors could unduly influence naming, while others said the policy provides needed structure and scrutiny.
A regional multi-hazard mitigation plan produced by Mark (regional staff) was presented for discussion by Captain Amy Agderian of the Clay County Sheriff’s Office and Emergency Management Director Anne Pozel. Commissioners were given a link to the draft (the document exceeds 1,000 pages) and told the plan will be returned on next week’s regular agenda for formal adoption and signature by the county. Staff said the plan is updated every five years, that 13 municipalities and school districts participated, and that local review and stakeholder input are being solicited prior to state and federal submission.
