Justice Haynie introduced the amendment, which the court said fixes a typographical error in the second sentence of section 11 regarding executive sessions. County legal counsel explained the corrected citation—referred to in the meeting as “Act 5 10 of 2023”—addresses authority for public entities to discuss cyber-security incidents and related internal policies in executive session.
Not all justices agreed on the interpretation: Justice Lane Scott said he could not support the change without further written clarification and announced he would abstain. The clerk’s roll call recorded 10 yes votes and one abstention; the ordinance was adopted.
The court characterized the change as a corrective amendment rather than a change in policy; counsel said the correct statute provides the procedural basis for the court to enter executive session on cyber-security matters. The court declared an emergency as part of the ordinance adoption; no litigation or additional policy language was added during the meeting.
