Planning staff told the commission the Master Use Permit change would let tenants seeking to offer recurring live music or entertainment obtain an annual entertainment permit from the Capitola Police Department rather than seek a separate conditional-use process for each tenant change. Staff recommended approval of both modifications.
The staff presentation said the applicant had secured support from the nearest sensitive receptor, a neighboring hotel, permitting live entertainment through 7 p.m. The Police Department reviewed the request and reported the property operated under an entertainment permit in 2022 and 2023 with no calls for service or complaints. Staff also reported an occupancy calculation showing Patio B can hold up to 26 people, and recommended a condition reflecting that limit.
Commissioners asked about overflow, sidewalk encroachment and ADA access. Planning staff said property managers bear the risk of over-occupancy, that single-event overcrowding could result in citations or fines from police or fire, and that recurring violations could trigger review or revocation of the Master Use Permit by the commission.
No members of the public offered comments during the public-comment portion for this item. Commissioners spoke in support of the application, citing the businesses' coordination with the nearby hotel and the potential to increase activity in the village while noting enforcement mechanisms exist if public-safety problems arise.
A motion to approve the Master Conditional Use Permit amendments passed on a roll-call vote: Commissioner Howard — Yes; Commissioner Q — Yes; Commissioner Westman — Yes; Vice Chair Christensen — Aye; Chair Esty — Aye.
The commission's approval adds conditions requiring the property to maintain an annual entertainment permit issued by the Police Department and limits Patio B to the approved seating and furniture configuration reflected in the staff report. Staff indicated the permit will continue to be subject to existing Master Use Permit conditions and enforcement pathways if complaints arise.
