Council approves time extension and conditions for Buenos Aires A/C expansion after code concerns

The City Council approved an extension-of-time request and related site-development approvals for an existing business at 5200 Vegas Drive, permitting a two-story addition and continued use of a 10-foot tall perimeter wall with razor wire under specified conditions.
Renee Rowland spoke for the applicant, who operates Buenos Aires Air Conditioning and Heating Inc., saying the owner needed additional space for employees and is in the building-permit process. "He's an existing small business owner that has had this business for many, many years... he would like to hire some additional employees and does not have the space for them currently," Rowland said.
Planning staff recommended approval of the requested extension of time while noting permit activity. Councilwoman Summers Armstrong removed the item from consent to press for compliance changes after a site visit and staff briefing. She asked that razor wire be removed and required the owner to open and stripe a side gate to ensure required parking during business hours, address on-site storage and garbage issues, and resolve outstanding permit submittals.
City attorney and planning staff recommended a revised condition set. Staff read a required private maintenance covenant condition into the record (Declaration of Private Maintenance Requirements, "DPMR") requiring recordation of an agreement describing ongoing private maintenance obligations for landscaping, striping, trash enclosures and other items prior to exercising site development plan review.
Council voted to approve the extension with the amended conditions and a shortened timeframe: the council directed staff to limit the extended approval period to one year (new expiration to 01/18/2026 as requested in discussion) and to require compliance actions including removal of razor wire within a short timeframe, opening of the parking gate during business hours, and recording the DPMR.
Staff will monitor compliance through code enforcement and the community development department. The approval preserves the expansion while adding enforceable maintenance and safety requirements.
