Committee advances bill to speed payment of shortened road-condition claims

Committee Counsel explained the bill amends the claims process so that when the Division of Highways agrees to stipulate to the amount of a claim or a portion of it, the clerk of the Legislative Claims Commission will prepare the stipulation (rather than the Division of Highways, as current law states). Counsel said the change codifies current practice and should speed the shortened-procedure process; whereas some claims can now take 18 months to two years, the change should allow payment in roughly six months in many cases.
Janet Haywash, Clerk of the Legislative Claims Commission, was present in the committee room, counsel noted. The committee adopted the bill by voice vote and reported it to the full Senate with a recommendation that it pass.
