City legal counsel said the nonprofit groups overseeing maintenance will have a three-year initial maintenance term included in third-party agreements incorporated into the city's contract.
Council asked whether the city could include a reversion (reverter) clause to return the property to the grantor if maintenance obligations were not met. City counsel said a reversionary right is generally a right the grantor may retain and cannot be unilaterally imposed by the grantee; counsel also cautioned that if the city later sold park property, statutory notice, bid requirements and election restrictions could apply.
The agreement requires Envision Mineral Wells and Friends of the Dog Park to enforce maintenance obligations and to ensure contractors comply with city regulations. The council moved to accept the dog park as presented; the motion passed 6-0.
